Terms of Service

By accessing or using the CableClix platform, website, mobile applications, or any related services (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and any additional terms applicable to specific services or features. If you do not agree to these Terms, you may not access or use the Platform. These Terms constitute a legally binding agreement between you and CableClix Inc. ("CableClix," "we," "our," or "us"), a corporation incorporated under the laws of the State of Texas, with its principal place of business in Austin, TX.

You must be at least 18 years of age to create an account or use the Platform. By using the Platform, you represent and warrant that: • You are at least 18 years old. • You have the legal capacity to enter into a binding contract. • You are not prohibited from using the Platform under applicable law. • All registration information you provide is accurate, current, and complete. If you are using the Platform on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms, and references to "you" include that entity.

3.1 Account Creation

To access certain features of the Platform, you must register for an account. You agree to provide accurate, complete, and current information and to keep it updated. You are solely responsible for maintaining the confidentiality of your account credentials.

3.2 Account Security

You are responsible for all activity that occurs under your account. You agree to notify CableClix immediately at support@cableclix.com if you suspect any unauthorized access to or use of your account. CableClix will not be liable for any losses resulting from unauthorized use of your account credentials.

3.3 One Account Per User

You may not create multiple accounts for the same individual. CableClix reserves the right to merge, suspend, or terminate duplicate accounts at its sole discretion.

4.1 Service Comparison & Bundling

CableClix provides a marketplace and comparison platform that allows users to discover, compare, and bundle telecommunications and streaming services, including internet, mobile, VoIP, streaming, and smart home services. CableClix acts as an intermediary and is not itself a telecommunications or streaming service provider.

4.2 Third-Party Services

The services, plans, and products displayed on the Platform are provided by independent third-party partners. CableClix does not guarantee the availability, pricing, quality, or performance of any third-party service. Your relationship with any service provider is governed by that provider's own terms and conditions.

4.3 Pricing & Availability

Pricing, plan details, and service availability are subject to change without notice and may vary by location. CableClix makes reasonable efforts to display accurate information but does not warrant that all displayed information is complete, current, or error-free. Confirmed pricing is subject to the service provider's final terms at checkout.

4.4 CableClix TV

The CableClix TV feature provides access to free, publicly available IPTV streams sourced from third-party providers including iptv-org. CableClix does not host, own, or control these streams. Stream availability, quality, and content may vary. Some streams may be geo-restricted or may become unavailable at any time.

4.5 Third-Party Streaming Disclaimer

Some channels and content displayed on CableClix are provided by third-party streaming services, including but not limited to Samsung TV Plus. These channels are not hosted, owned, or operated by CableClix. All content is streamed directly from the respective third-party providers and may be accessed independently outside of the CableClix platform. CableClix acts solely as a content discovery and access interface, providing links or access points to publicly available streaming services. CableClix does not control, manage, or guarantee the availability, accuracy, or legality of any third-party content. All rights, trademarks, and content belong to their respective owners. By accessing third-party content, users agree to be bound by the respective terms and conditions of those providers.

5.1 Permitted Use

You may use the Platform only for lawful personal or business purposes consistent with these Terms and all applicable laws and regulations.

5.2 Prohibited Conduct

You agree not to: • Use the Platform for any illegal, fraudulent, or unauthorized purpose. • Attempt to gain unauthorized access to any part of the Platform or its infrastructure. • Interfere with or disrupt the operation of the Platform, servers, or networks. • Scrape, crawl, or use automated tools to extract data from the Platform without prior written consent. • Impersonate any person or entity, or misrepresent your affiliation with any person or entity. • Transmit any viruses, malware, or other harmful code. • Engage in any conduct that could damage, disable, or impair the Platform. • Reverse engineer, decompile, or disassemble any part of the Platform. • Use the Platform to send unsolicited communications (spam). • Violate any third-party rights, including intellectual property or privacy rights.

6.1 Program Terms

CableClix may offer a referral program that allows existing users to earn account credits by referring new users to the Platform. Referral credits are issued at CableClix's sole discretion and are subject to verification of eligibility.

6.2 Credit Conditions

Referral credits have no cash value, are non-transferable, and may only be applied to CableClix account balances or qualifying service purchases. Credits expire 12 months after issuance unless otherwise stated.

6.3 Abuse

Self-referrals, use of fake accounts, or any attempt to artificially inflate referral credits is strictly prohibited and may result in account suspension and forfeiture of all credits.

7.1 Platform Fees

CableClix may charge fees for certain premium features or services. All fees are stated in US dollars and are non-refundable unless expressly stated otherwise or required by applicable law.

7.2 Third-Party Billing

Charges for third-party services (e.g., internet plans, streaming subscriptions) are billed directly by the respective service provider and are governed by that provider's billing terms. CableClix is not responsible for charges made by third-party providers.

7.3 Taxes

You are responsible for all applicable taxes, levies, and duties associated with your purchases, excluding taxes on CableClix's income.

8.1 CableClix IP

All content, features, and functionality on the Platform — including but not limited to text, graphics, logos, icons, images, audio clips, software, and design — are the exclusive property of CableClix or its licensors and are protected by United States and international copyright, trademark, patent, and other intellectual property laws.

8.2 Limited License

CableClix grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your personal, non-commercial use. This license does not include the right to copy, modify, distribute, sell, or otherwise exploit any portion of the Platform.

8.3 User Content

By submitting any content to the Platform (including reviews, feedback, or support communications), you grant CableClix a worldwide, royalty-free, perpetual license to use, reproduce, and display such content in connection with the operation and promotion of the Platform.

9.1 No Warranty

THE PLATFORM AND ALL CONTENT, SERVICES, AND FEATURES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

9.2 Service Availability

CableClix does not warrant that the Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We reserve the right to modify, suspend, or discontinue any part of the Platform at any time without notice.

9.3 Third-Party Content

CableClix does not endorse, control, or assume responsibility for any third-party content, products, or services accessible through the Platform. Your use of third-party services is at your own risk.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CABLECLIX, ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE PLATFORM. IN NO EVENT SHALL CABLECLIX'S TOTAL CUMULATIVE LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO CABLECLIX IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00 USD). Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.

You agree to indemnify, defend, and hold harmless CableClix and its officers, directors, employees, agents, affiliates, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: • Your use of or access to the Platform. • Your violation of these Terms. • Your violation of any third-party right, including any intellectual property, privacy, or contractual right. • Any content you submit to the Platform. • Your fraudulent or intentional misconduct.

12.1 Informal Resolution

Before initiating any formal dispute, you agree to first contact CableClix at legal@cableclix.com and provide a written description of the dispute. We will attempt to resolve the issue informally within 30 days.

12.2 Binding Arbitration

If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The arbitration shall take place in Austin, Texas, or by phone or videoconference.

12.3 Class Action Waiver

YOU AND CABLECLIX EACH WAIVE THE RIGHT TO A TRIAL BY JURY AND TO PARTICIPATE AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING.

12.4 Exceptions

Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights.

These Terms and any disputes arising hereunder shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Subject to the arbitration agreement in Section 12, you consent to the exclusive jurisdiction of the state and federal courts located in Travis County, Texas.

14.1 By You

You may terminate your account at any time by contacting us at support@cableclix.com. Termination does not relieve you of any obligations incurred prior to termination.

14.2 By CableClix

CableClix reserves the right to suspend or terminate your account and access to the Platform at any time, with or without cause or notice, including for violations of these Terms, suspected fraud, or extended periods of inactivity. Upon termination, your right to use the Platform ceases immediately.

14.3 Survival

Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, and governing law shall survive any termination of these Terms.

CableClix reserves the right to modify these Terms at any time. When we make material changes, we will notify you by email or by posting a prominent notice on the Platform at least 14 days before the changes take effect. Your continued use of the Platform after the effective date constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Platform.

16.1 Entire Agreement

These Terms, together with our Privacy Policy and any additional terms you accept, constitute the entire agreement between you and CableClix with respect to the Platform and supersede all prior agreements.

16.2 Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.

16.3 No Waiver

CableClix's failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

16.4 Assignment

You may not assign or transfer your rights under these Terms without CableClix's prior written consent. CableClix may freely assign these Terms, including in connection with a merger, acquisition, or sale of assets.

16.5 Force Majeure

CableClix shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including natural disasters, pandemics, government actions, internet outages, or third-party service failures.
